Our client came to us seeking advice around his rights to compensation for the sexual abuse he had experienced as a child between 10-12 years of age.
Our client was groomed by his male teacher in a small regional school – told his relationship to be of a ‘special’ status and recommended to attend extracurricular activities before school, after school and on weekends. The sexual abuse by the teacher occurred in and outside of the school.
The impact of the abuse had a profound impact on our client’s life. Our client became socially withdrawn, had feelings of guilt, blame and anxiety which negatively impacted upon his ability to perform at school. It took some time for him to realize that he had been abused rather than being an elite student.
The impacts of the abuse continued into our client’s adult life and he developed post-traumatic stress disorder, social anxiety and would experience depressive symptoms and panic attacks. This impacted our client’s personal and work relationships, and inevitably, affected his performance at work and the opportunities he had.
The sum of money received by the client may not wholly resolve the traumatic experience of abuse, however it does provide our client with recognition of the abuse he suffered as a vulnerable child who was isolated and powerless before the perpetrator. This sum of money is recognition that the abuse our client sustained was wrong and an extreme breach of trust that was allowed by the NSW government.
At GMP Law, we understand the courage that it takes to come forward and discuss traumatic experiences of childhood sexual abuse with others. Our compassionate team will fight to achieve maximum justice for survivors of institutional and historical sexual abuse.
If you have been the subject of abuse, we are hear to listen and provide you with a confidential, no obligation consultation with our expert solicitors.
Helping sexual abuse survivors gather the evidence they need to bring a successful compensation claim is part of the service Gerard Malouf & Partners provides. You shouldn’t feel that you need to have done this work yourself before coming and speaking to us.
Based on our extensive experience of handling and winning sexual abuse compensation claims evidence typically includes:
The awarding of financial compensation in civil cases breaks down into four areas:
Cost of treating the immediate physical or psychological injury
Ongoing medical costs, such as domestic care to recuperate from long-term injuries
Non-economic (pain and loss) damages for psychological or emotional distress
Loss of earnings or superannuation if the incident leaves you unable to work
In some cases, courts have awarded victims “aggravated and exemplary damages”. This usually occurs in special or extreme circumstances when the court wishes to make an example of the defendant.
