Sydney Woman Awarded $75,000 in Compensation Following Negligent Excision of Carcinoma

This matter involved a lady who attended on her general practitioner in 2017 for a biopsy of a lesion on her left shin. The histology report revealed a squamous cell carcinoma. Rather than refer her on for surgery, this lady’s general practitioner opted to perform a wide excision of the lesion, and had it performed by their trainee registrar.

The wound site became infected following the procedure, and the wound dehiscence developed to the point where the wound needed to be debrided and a split skin graft applied. Our client was left with an unsightly left leg following the procedure, and she contacted Gerard Malouf & Partners seeking assistance for her cosmetic injury.

This matter was run by Ms Jayne O’Sullivan, a very experienced medical negligence solicitor. She and her team sought the expert opinion of general practitioners, who opined that such surgery should never have been performed by a trainee general practitioner, and should have been performed in a sterile surgical environment. A plastic surgeon commented on the cost of further reconstruction and surgery to the unsightly area on our client’s left leg, and a consultant psychiatrist assessed the psychological impact this injury had on our client.

While this case may not have been significant from a purely financial perspective, GMP treat every injury seriously and were committed to obtaining the best possible outcome for our client in line with our “maximum justice” approach to all cases.
The matter progressed to a settlement conference, where our client was paid $75,000 in compensation for her injuries and disabilities. She will be able to use this money for any future treatment for her leg by way of cosmetic and plastic surgery, as well as for therapy and counselling for the psychological trauma she has suffered as a result of this medical negligence.
