This case concerned a gentleman who attended on his General Practitioner in 2014 with neck pain. He underwent radiographic investigation, but no issues were observed. In March 2014, this man again consulted his General Practitioner with lower back pain as well as neck pain, and further investigations noted that his L4/5 disc space was slightly narrow with small posterior lipping suggesting early degenerative disc disease.
In July 2014, our client began seeing a chiropractor. In October 2014, he suffered an immediate aggravation to his cervical spine during a neck manipulation conducted by the Defendant. This man continued to attend on his chiropractor but his cervical spine condition did not improve.
Our client was diagnosed with post-traumatic fibrosis of the paraspinal muscles in the cervical and thoracic region and was in considerable debilitating pain which impeded him in multiple aspects of his life. He was impacted both physically and psychologically as a result of the subject incident.
This gentleman contacted Gerard Malouf & Partners in 2018, seeking assistance for the terrible position he was in. This matter was handled by Mr Keegan Behrens, a senior medical negligence expert solicitor at the firm. Keegan used his considerable experience and know-how to figure out what our client’s case was, and briefed relevant medical experts seeking their opinions. Armed with the supportive expert opinion of a chiropractor, Keegan commenced proceedings in the NSW District Court on the recommendation of a specialised barrister who was briefed for this matter. Keegan also obtained the reports of a neurologist, occupational therapist and psychiatrist to better understand and show how exactly our client had suffered as a result of his treatment at the hands of the defendant chiropractor.
This matter ultimately settled at mediation where a result of $220,000 was obtained. This was an excellent result on a difficult negligence case and our client was very pleased that maximum justice had been obtained.
