In June 2019, our client was an admitted patient of the First Defendant when he complained of chest pain and was assessed by the Second Defendant. Following this assessment, our client underwent an ultrasound extracranial carotid and vertebral vessels doppler which showed 50% to 69% right-sided internal carotid stenosis and total occlusion of the left internal carotid artery.Â
Due to the seriousness of these blockages, our client was at a high risk of developing a stroke and should have been referred urgently for a vascular consultation regarding the serious carotid blockage.
However, this was not the case, and there was a significant delay in actioning this urgent referral. Due to the delay, our client unfortunately suffered a catastrophic cerebral emboli to the right side of his brain causing left-sided hemiparesis and also aphasia; i.e. a stroke.
Our client continues to suffer a massive decline in his physical and cognitive abilities, as well as psychological sequelae. Our client suffers continued weakness in the left-sided limbs and has considerable difficulty standing and walking. Our client has required ongoing domestic and commercial care since the incident due to his ongoing disabilities.
During the course of this matter, GMP consulted with and received several supportive opinions from our trusted medical experts. Our medical experts agreed that had the Defendants addressed the blockage in the right internal carotid artery in a timely fashion, it is more than likely that our client would have avoided the significant stroke that he subsequently suffered. Overall, our experts concurred that our client was not provided with a reasonable standard of care in a timely manner, and that the Defendants were liable for this breach.
After several hours of difficult negotiations at a mediation, GMP successfully won a settlement in the sum of $550,000 for our client.
