A man from Blacktown was awarded over $180,000.00 after suffering injuries to his right hand and fingers following a workplace injury. He was working as a fabricator, using a bench saw to cut piece of metal when a smaller piece flung out of the machine, striking his right hand and fingers, causing the partial amputation of his right index finger. This gentleman suffered injuries to four of his fingers on his right hand, undergoing plastic surgery for the finger that was partially amputated. He continues to suffer stiffness in his hands although the pain appears to have dissipated. Medical assessment has been that his injuries have healed as best as they can.
This man came to see our highly specialised workers compensation lawyers at our Blacktown office in order to commence a workers compensation claim. The worker was medically assessed and he was found to have a whole person impairment of greater than 15%. As a result of this, a claim for work injury damages was commenced. Work injury damages, otherwise known as common law damages, are a claim purely for economic loss and can only be claimed if a worker is assessed as having a whole person impairment of greater than 15%.
After many months of preparation by his workers compensation solicitors, the workers claim was taken to a settlement conference in which the client and his solicitors had a figure in mind that would constitute a reasonable settlement. On the day of settlement offers were made, however this figure was not obtained. For some days after, the solicitors at Gerard Malouf continued to maintain contact with the workers compensation insurer, exchanging offers until eventually a figure of over $180,000.00 was agreed to. This figure was broken down as follows:
1) Work Injury Damages (Economic Loss): $160,000.00
2) Payment for 16% Whole Person Impairment: $23,650.00
