Car Accident Victim Compensated $690,000 in Damages

With multiple fractures and injuries to her shoulder, arms, and ribs, our client was absent from her employment for a period of approximately two years. She was able to return to work on very light duties in November 2022, but since has not been able to return to her pre-injury employment.

Based on the significance of her injuries, which included the requirement for ongoing future surgery, the insurer did concede the threshold for the attainment of damages for non- economic loss (NEL) (General Damages) and the matter was listed for a settlement conference between the parties.

The claimant had the benefit of an Occupational Physician’s report who supported a permanent partial ongoing incapacity for employment. This, along with the claimant not having returned to her pre-injury employment level after three years, strengthened her case.

The above combined medical evidence in conjunction with our client’s ongoing symptoms, disabilities and prognosis for only slight improvement, resulted in a settlement of $690,000 inclusive of legal costs.
