Central Coast woman receives $40,000 for tattoo removal gone wrong

In this medical negligence matter, Gerard Malouf & Partners successfully obtained financial compensation for a 23 year old female whose ankle became infected as a direct result of a tattoo removal gone wrong.

Our client consulted the Defendant, a laser clinic on the Central Coast, to remove her tattoo. After the tattoo was removed, her ankle became swollen and hot.  Our client consulted her GP and was diagnosed with an infection and cellulitis. Our client then consulted a vascular surgeon who confirmed the diagnosis.  Our client developed psychological issues as she became increasingly embarrassed about the disfigurement of skin on her left ankle and extensive scarring.

Our client approached the cosmetic surgery lawyers at Gerard Malouf & Partners to determine if she had a medical negligence case. After considering the facts, the senior and competent medical negligence lawyer advised that a small claim could be made.

A liability report was obtained which confirmed that the Defendant had been negligent in the medical care it provided as, amongst other things, they failed to trial the laser on our client’s skin and provide adequate treatment. Based on the report, the claim was commenced in the District Court of New South Wales. The Defendant strongly disputed the issue of liability as our client had signed a consent form, which they alleged advised her of the possibility of infection and scarring. Given the issues regarding liability, a barrister was briefed. The barrister was able to assist in litigating the matter and navigating the issue of liability.

In order to minimise costs we organised an informal settlement conference to resolve the matter before it was heard by a judge of the District Court of New South Wales. Counsel in conjunction with Mr Raina were able to persuade the Defendant to settle the claim. The matter settled for $40,000.00 and the client was extremely happy with the sum she received.
