Man receives $875,000 in compensation following a motor vehicle accident

Our client was in his early 50s when he approached Gerard Malouf & Partners some years ago following a motor vehicle accident. He was approaching a local Westfield when a car travelling in the opposite direction veered across the double line of the roadway, colliding with the front of our client’s vehicle. He sustained significant physical and psychiatric injuries as a result.

As is the usual course in motor vehicle accident claims, once the insurer had admitted liability and we had obtained our own medico-legal assessments, we referred our client to the Medical Assessments Service. His injuries were assessed at over the 10% threshold, however, the insurer appealed this decision. They were successful in this appeal.

However, seeing our client continue to deteriorate over the course of his claim, we qualified further medico-legal doctors on behalf of our client, had him reassessed, and proceeded to apply to the Medical Assessment Service for a Further Assessment of our client. Despite the initial assessments determining our client fell under the threshold, this was not accepted by our Accredited Specialist team and further evidence was obtained on our client’s behalf. Ultimately those MAS assessments revealed our client to have significant injuries both physically and psychologically, in light of our updated evidence, as a direct result of the motor vehicle accident, which had devastated this once hard working man’s life and family.

In the meantime, we had lodged an application with the Claims Assessment Resolution Service to protect this man’s rights and apply continued pressure on the CTP insurer to resolve the matter for the right sum. Once we were in receipt of the new MAS Certificates and having set the matter down for a General Assessment Hearing, we organised a settlement conference with the CTP Insurer. At the settlement, after difficult negotiations with the CTP insurer, we were able to resolve this claim on behalf of our client. Our client was elated to have received compensation over and above his expectations, when his claim had received much scrutiny from the CTP insurer previously.
