In early 2024, Mansour’s life was turned upside down during his morning commute to work in Blacktown. A builder and quality management systems specialist for one of the world’s largest engineering companies, he was stopped at an intersection on Sunnyholt Road when a 10-tonne truck crashed into the back of his vehicle.
“I noticed via my rearview mirror a 10-tonne truck doing the Sunnyholt Road speed limit,” Mansour recalls. “I panicked, however, with very little that I could do to avoid the accident, I found myself being hit from behind. When I got out of my car, the truck driver apologised and shared that he was on his phone at the time.”
What initially seemed like a routine traffic incident quickly became a life-altering event. After visiting a medical centre and undergoing extensive imaging, the true extent of Mansour’s injuries became clear.
“When I arrived at work, I started to experience numbness with pins and needles to my neck and shoulders running down my arms and fingers,” Mansour explains.
“After having CT scans, ultrasound, and MRIs, it was identified that I had sustained injuries to my neck/cervical C5/C6-C6/C7, supraspinatus tears to my shoulders and hip, and a 40mm rectus abdominal diastasis tear to my stomach wall.”
The accident’s impact extended far beyond physical injuries.
A devoted family man, Mansour had always prioritised time with his five children, supporting their sporting activities and enjoying family outings. The accident dramatically altered this dynamic.
“The injuries affected my daily activities in a big way. I was unable to work or return to my personal life and work activities. In turn, this created an unhealthy environment/relationship with my wife of 25 years and five children to the point where my family life was getting destroyed.”
Before finding GMP Law, Mansour’s path to justice was fraught with challenges. Two previous law firms had failed to secure his entitlements, leaving him increasingly discouraged and stressed.
Tanya To, Special Counsel at GMP Law, explains: “The key challenge was that the claim had already been partly pursued by two former firms which were, in my view, not properly prepared. The case had to be redirected to get back on track. Further, the insurer had served a report from an engineer expert reconstructing the collision to allege the injuries could not have been caused in the manner particularised, so medical causation was also an issue to be overcome.”
GMP Law’s approach was methodical and comprehensive.
“We conducted a fast, efficient review of the file and evidence,” Tanya notes.
“We engaged both psychiatric and orthopedic experts to assess the significant physical and psychological injuries. Most importantly, we successfully overturned the insurer’s denial of both the threshold and pain and suffering entitlement – something both former solicitors had failed to achieve.”
The turning point came when GMP Law successfully demonstrated that Mansour’s injuries met the necessary threshold for damages, including non-economic loss. This victory was particularly significant under the Motor Accident Injuries Act 2017, which has stricter requirements than previous legislation.
"Had the client not changed firms, his case would likely have been closed, and he would not have received any lump sum payment and/or medical treatment for life," Tanya emphasises.
"We not only secured a substantial settlement but also ensured ongoing treatment coverage for life.”
Alongside securing the maximum possible settlement, Tanya was equally dedicated to minimising costs, ensuring Mansour received the highest net amount possible.
“The costs claimed by the former solicitors were resolved after long and winding negotiations to which they agreed to significantly reduce – meaning more money for the client after payment of all fees and expenses “
For Mansour, the successful resolution means more than just compensation. It represents recognition of his suffering and a pathway to recovery.
As he puts it, “The resolution achieved changed my life in a big way—not being controlled by the insurers, which gave me my independence to start a new chapter. It allowed me to focus on improving my health, paying off the debts I was left with, and restoring my dignity.”
Through GMP Law’s representation, he not only secured a significant settlement but also gained access to lifetime treatment benefits.
As Tanya concludes: “This case highlights that, under the Motor Accident Injuries Act 2017, injured road users are at risk of losing ongoing entitlements without proper legal representation. Instead of spending time and money denying claims, insurers could better serve everyone by providing the proper coverage.”
