Melbourne resident receives over $120,000 after slip and fall in prominent Sydney shopping centre chain

On 21 December 2015 the Plaintiff attended the defendant’s premises in the hope of completing his weekly shopping. At the time of the accident there was a lot of heavy rain around Sydney. 

As the Plaintiff entered through the main door of the shopping centre he slipped and fell landing heavily on his lower back, sustained disc bulges to two levels of his lumbar spine, damage to his pelvis as well as right hip.

The Plaintiff required to undergo a lot of treatment and investigations, with specialists and scans which came at considerable cost to himself. Further the Plaintiff was unbale to engage in the domestic chores he once did and relied heavily upon his family for care for an ongoing basis.

As a result of the injuries sustained the Plaintiff was unable to engage in his employment and lost his job. It took the Plaintiff most 10 months to find alternative employment.

The Plaintiff attended Gerard Malouf and Partners and spoke with Richele Nelsen in early 2016.  After obtaining the Plaintiff’s clinical records and details of the cleaning systems of the shopping centre. After considering the information contained within Richele felt confidence in her ability to succeed in this matter.

Proceedings were commenced against both the owner of the shopping centre and the cleaning company engaged to ensure that the floors remained clean. Richele argued that the shopping centre did not provide adequate wet weather safety plans or warning to customers while the cleaners failed to ensure that the floors remained dry and slip resistant.

Richele wasted no time in booking the Plaintiff into seeing an orthopaedic surgeon as well as a psychologist and occupational therapist so that these medical experts with could provide opinions on the extents of the Plaintiff’s injuries and what his treatment regime would be. The experts also commented on the Plaintiff’s ability to continue to work until retirement as well as his continuing ability to look after the home.

Armed with this information Richele approached the defendant solicitors to engage in an informal settlement conference.  Ultimately the matter settled for over $120,000 leaving the Plaintiff very pleased knowing that his needs would be looked out for into the future.
