Mrs C was a passenger on a Sydney Bus who braked suddenly causing Mrs C to strike her head on the seat in front and to hit her knees. These impacts also caused her to sustain a neck and back injury.
As a result of the accident Mrs C was transported to hospital to where she was treated.

Action Taken:
At Gerard Malouf and Partners a personal injury claim form was lodged on behalf of Mrs C and the claim number was allocated by the third party insurer who ultimately accepted liability for the accident.
When Mrs c injuries had stabilised we arranged for her to be assessed by various doctors including an orthopaedic surgeon, psychiatrist, occupational physician and an occupational therapist. All of this doctors commented on Mrs X injuries and need for treatment, her capacity to work and her need for domestic care and assistance.
The insurer refused to accept Mrs C injuries were greater than 10% therefore a dispute arose which was referred to the Medical Assessment Service to determine. The Medical Assessment Service appointed doctors who assessed Mrs X and those doctors found that her injuries were less than 10% whole person impairment.
Following receipt of those reports an appointment was arranged to discuss the matter at an informal settlement conference and after substantial negotiations the matter could not be resolved. It was subsequently referred to CARS who appointed an assessor to assess the value of the claim.
Conclusion:
The assessor awarded Mrs C the sum of $549,000 even though her injuries were found to be less than 10% whole person impairment. Mrs C was thrilled with the outcome and she was not expecting to receive that much compensation however she was thankful and grateful that the firm was able to put that amount of money in her pocket noting that she continued to have restrictions at work and was unable to return to her pre-accident hours and duties.
